Avaya: 2009 Avaya Award 12/23/09
To: All Avaya Local Presidents
We were notified by a Local representative that Avaya was rolling out a Sales Referral Program. The Company has indicated that they bargained
this: they did not. Avaya has also indicated we are in agreement with this Sales Referral program: we are not.
We have spoken with the Company and we explained that this was stopped during bargaining for a reason: we made referrals and the Company sent those to Business Partners. CWA is not telling you don?t do this but when all that work goes to Business Partners, why would anyone do a Sales Referral? We?re cutting our own throats.
We are filing a bad faith bargaining and a failure to bargain Board Charge against the Company. We will keep you posted as we make progress.
Thank you for your attention to this matter.

We have been notified by Avaya that only the minimum payout will be made because the Company did not meet their financial targets for fiscal year 2009. (See their message below.)
CWA has requested information from Avaya to substantiate this claim. We will keep you informed as we receive further information.
